TERMS OF SERVICE

These Terms of Service ("Terms") form a binding agreement between you and Forefab Solutions Pvt Ltd ("we," "us," or "our"), the operator of the Gossip mobile application and any related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms refer to and incorporate our Privacy Policy, which explains how we handle your personal information.

1. Eligibility and 18+ Requirement

Gossip is intended for adults aged 18 and over. By using the Services, you represent and warrant that:

You are at least 18 years old, or the age of majority in your jurisdiction (whichever is greater).
You have the legal capacity to enter into a binding agreement with us.
Your use of the Services does not violate any applicable law or regulation.

If we discover that an account belongs to a person under 18, we will suspend or delete that account without notice.

2. Your Account

To use Gossip, you must sign in with a valid Google account. You are responsible for maintaining the security of your Google credentials, and for all activity that occurs under your account. You agree to provide accurate information during onboarding (nickname, gender, age, interests) and to keep that information up to date.

You may use only one account at a time. We may, at our discretion, refuse to permit additional accounts associated with the same person, device, or payment method.

3. Acceptable Use

Gossip is built on the principle that real people are on the other end of every conversation. You agree to use the Services in a manner consistent with this principle. The following are prohibited:

Harassment and hate. Slurs, threats, bullying, doxing, targeted hate, or any conduct intended to demean another user.
Sexual content involving minors. Any content that sexualizes, depicts, or solicits minors is strictly prohibited and will be reported to law enforcement and the National Center for Missing & Exploited Children (NCMEC) where applicable.
Adult or NSFW content. Photos and behavior must remain PG-13. Pornographic, graphic, or sexually explicit content is not permitted.
Violence and gore. Content depicting graphic violence, gore, self-harm, or animal cruelty is not permitted.
Impersonation. Pretending to be another person, brand, or organization is prohibited.
Off-platform solicitation and spam. Repeatedly sending the same or similar message, sharing handles or links to other services (Telegram, WhatsApp, Snapchat, Discord, OnlyFans, Cash App, etc.) for the purpose of moving conversations off Gossip, or distributing promotional content.
Scams and financial solicitation. Asking for money, gift cards, payment account details, or anything else of monetary value.
Illegal activity. Any conduct that violates applicable law, including drug sales, weapons sales, fraud, or unauthorized access to computer systems.
Circumvention. Reverse-engineering the app, attempting to bypass moderation, evading suspension, or interfering with the operation of the Services.
Automated use. Operating bots, scrapers, or any automated tools that interact with the Services on behalf of one or more users.

4. User Content

You retain ownership of the messages, photos, voice notes, and other content you submit through the Services ("User Content"). However, by submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to host, store, transmit, display, and process that User Content solely for the purpose of operating and improving the Services.

You represent that you have the right to submit any User Content you provide and that it does not violate the rights of any third party.

We do not pre-screen or actively monitor User Content. However, we reserve the right (but not the obligation) to review, remove, or refuse any User Content we believe violates these Terms, applicable law, or our community standards.

5. One-Time Photos and Video

Photos and video messages sent through Gossip — in both random chat and friend chat — are one-time view. Once the recipient opens the message, the underlying file is deleted from our servers and cannot be reopened. We do not provide a feature to save photos or video, and we do not maintain a persistent media gallery.

While we delete files server-side after viewing, you understand and accept that recipients can take screenshots or photograph their own screen with another device. Gossip uses the platform's anti-screenshot flag (FLAG_SECURE on Android) to discourage this, but we cannot prevent it entirely. Do not send any photo or video you would not be comfortable being seen.

6. Gossip Pro and Subscriptions

Gossip Pro is an optional paid upgrade that unlocks features including voice and video calling, removal of advertisements, gender filtering, accent color customization, and unlimited friend chats. Pro is offered in three forms:

Monthly subscription — auto-renews every month until cancelled.
Yearly subscription — auto-renews every year until cancelled.
Lifetime purchase — one-time payment for indefinite access.

All purchases are made through Google Play Billing. Payment will be charged to your Google account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions from your Google Play Store account at any time.

Pricing is shown to you within Google Play before purchase. Prices may vary by country and may change over time; existing subscribers will be notified of any price changes in advance, in accordance with Google Play policies.

7. Refunds and Cancellations

Refunds for purchases made through Google Play Billing are handled by Google in accordance with the Google Play refund policy. We do not directly process refunds.

If you cancel a subscription, your Pro features will remain active until the end of the current billing period; they will not be renewed thereafter. Lifetime purchases are non-refundable except where required by applicable law.

8. Advertising

The free tier of Gossip is supported by advertisements served through Google AdMob. Ads may include banners and interstitials and, where you choose, rewarded ads that grant additional in-app benefits. Pro subscribers do not see advertisements within the Services.

You acknowledge that ad targeting and delivery is performed by Google in accordance with its own policies and your device-level ad personalization settings. We do not control the specific ads shown to you.

9. Reports, Strikes, and Account Suspension

Gossip uses a combination of community reporting and automated detection to enforce these Terms.

Any user can report another user using the report (flag) icon. Each report is reviewed.
If your account receives five (5) reports from different users, your account will be automatically suspended.
Our automated systems may also issue strikes or directly suspend accounts that send copy-paste spam or content promoting off-platform services, in accordance with the conduct rules in Section 3.
We may also suspend or permanently terminate any account at our discretion if we believe it has violated these Terms or applicable law, even where no user reports have been received.

Suspension means you can no longer access matching, friend chats, voice/video, or other Service features. Your account data is retained subject to the retention rules in our Privacy Policy.

10. Appeals

Active Gossip Pro subscribers may submit one appeal per suspension through the in-app appeal form. We will review the appeal and notify you of our decision, typically within 7 to 14 days. Our decision on appeal is final.

Free-tier users do not have access to the appeal process. This is intentional: the appeal process exists to protect long-term, committed users from rare false-positive suspensions, and supporting an appeal queue for the entire user base is not feasible at our current scale.

11. Intellectual Property

The Gossip name, logo, app interface, source code, and all other materials supplied by us are owned by Forefab Solutions Pvt Ltd and are protected under applicable copyright, trademark, and other intellectual property laws. You are granted a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or lease any part of the Services or attempt to derive the source code.

12. Third-Party Services

The Services rely on third-party providers including, without limitation:

Google — for sign-in, hosting (Firebase), push notifications, analytics, billing (Google Play), and advertising (AdMob).
Agora — for voice and video call routing.

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the practices, content, or availability of any third-party service.

13. Service Availability and Changes

We aim to keep the Services available at all times but cannot guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, technical issues, or events outside our control. We may add, remove, or modify features at any time without prior notice.

14. Disclaimers

The Services are provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not endorse, guarantee, or assume responsibility for the conduct of any user. You interact with strangers at your own risk. You are solely responsible for evaluating the people you meet through the Services and for any decisions you make based on those interactions.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Forefab Solutions Pvt Ltd, its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, loss of data, loss of goodwill, or other intangible losses, arising out of or relating to your use of the Services.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Services shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Indian rupees (INR 100). Some jurisdictions do not allow the exclusion of certain damages, so portions of this limitation may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Forefab Solutions Pvt Ltd and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any User Content you submit.

17. Termination

You may stop using the Services at any time. You can delete your account from within the app's Settings, which will permanently remove your profile, message history, friendships, and other associated data, subject to retention requirements described in our Privacy Policy.

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, liability limitations, indemnification, and dispute resolution — will continue to apply after termination.

18. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India, and you consent to that jurisdiction and venue.

Nothing in these Terms limits any non-waivable consumer protection rights you may have under the laws of your country of residence.

19. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a new "Last updated" date at the top of this page. If we make material changes, we will notify you in the app or via the email address associated with your Google account. Continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms.
